Except as expressly permitted, no portion of the services may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written permission.
Open-source software distributed by LIMNMEDIA remains subject to the licenses accompanying those projects.
User Content
If you submit content, feedback, suggestions, project files, comments, or other materials to LIMNMEDIA, you grant LIMNMEDIA a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the services.
You represent that you have the necessary rights to provide such content.
Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted availability.
Services may be modified, suspended, restricted, or discontinued at any time without liability.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
LIMNMEDIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMNMEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
IN NO EVENT SHALL LIMNMEDIA'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO LIMNMEDIA FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless LIMNMEDIA, its officers, members, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from:
- Your use of the services
- Your violation of these Terms
- Your violation of applicable law
- Content or materials you submit
Termination
We may suspend or terminate access to services at our discretion if we reasonably believe you have violated these Terms, created security risks, or engaged in unlawful conduct.
Upon termination, provisions relating to intellectual property, liability limitations, indemnification, and dispute resolution shall survive.
Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Export Compliance
You agree not to use, export, re-export, or transfer any LIMNMEDIA products or services in violation of applicable export control or sanctions laws.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.
Changes to These Terms
We may modify these Terms from time to time. Updated versions will be posted with a revised effective date.
Continued use of the services after changes become effective constitutes acceptance of the revised Terms.
